Terms & Conditions, Privacy Policy, and Informed Consent
– Last Updated: 19 March 2025 –
This page covers our Terms & Conditions (the rules for joining and using the program), Privacy Policy (how we protect your information), and Informed Consent (your agreement to participate, including health advice). It only applies if you enrol as a participant (we’ll call you “you” or “participant”).
Important Notes for Clarity:
- If you’re just browsing our website (http://fireforlife.health) without signing up, simpler rules apply. For example, we don’t collect your health details, and our privacy rules only cover basic website use (like cookies for site features).
- To enrol, you must read this, understand it, and check the box at the end. This creates a legal agreement between us. If anything is unclear or you disagree, don’t enrol – email us at info@fireforlife.health for questions.
- We’re Biome Solutions (Pty) Ltd trading as FIRE for Life, a South African company (Registration Number: 2024/223215/07). Our address: Sprig Wellness Centre, 43 Panorama Drive, The Links, Somerset West, Cape Town, 7130, South Africa. Email: info@fireforlife.health | Phone: +27 66 236 4044 | Website: http://fireforlife.health.
This document follows South African law and meets the Protection of Personal Information Act (POPIA, Act 4 of 2013) in South Africa – think of POPIA as our way of making sure your info is handled with care, like a doctor keeping your records private. It also aligns with Namibia’s Data Protection Act (which is similar to POPIA – we use the same strong protections). For people from other countries, we follow rules like the EU’s GDPR or U.S. health data standards (e.g., HIPAA/HL7) where they apply. But South African law is the main one, unless your local laws are stricter (you handle that yourself). If you’re international, you agree to follow our rules and South African courts if needed.
Terms & Conditions (The Rules for Our Program)
What We Offer
Our program is a 180-day online journey with education, lifestyle tips, and support to help reverse insulin resistance. Here’s what’s included:
- Science-based lessons and resources on an online learning platform – you agree to use it only for your personal learning.
- Regular video consultations with health experts (like doctors, nurses, and coaches) registered in South Africa or Namibia. They give advice within their allowed roles (e.g., education, not surgery).
- Tools to track your health, like logging blood sugar or blood pressure.
- Online forms to share your personal and health details.
Key Warning: This is not emergency care or a replacement for your regular doctor. Health results depend on you – no promises are made. Always check with your local health care provider before big changes to diet, exercise, or meds.
Who Can Join
- You must be at least 18 years old. (We don’t enrol anyone under 18 to keep things simple.)
- It’s for adults wanting to improve metabolic health – not for urgent medical problems.
- We can say no to enrolment or cancel it anytime for safety, legal, or fit reasons (e.g., if it’s not right for your health).
How the Program Works
- Signing Up: Give us basic info (like your name and email), agree to this document, and fill out health history forms.
- Sharing Health Info: Update us weekly (daily is best) on things like blood sugar and blood pressure through our secure system. You agree to let your lab send blood test results in a standard digital format (one that works easily with our records) to Dr. Snyman (Practice Number: PR 014 000 1508156). We’ll add them to our secure electronic health records for review and reports.
- Consultations: You’ll have virtual chats with our team for tips and motivation. Our experts work from South Africa or Namibia and follow local rules. If your country needs doctors licensed there, we’ll stick to general advice – see your local provider for meds or treatments.
- Your Part: Be committed, share accurate info, and follow suggestions. Use everything just for yourself – no sharing logins or copying our materials.
Payments
- Fees are in South African Rand (ZAR). If using a Namibian medical aid, we can convert to Namibian Dollars (NAD) at current rates.
- Pay by credit card online or claim from your medical aid if it covers this.
- Money-Back Guarantee: Not happy? Email us within 30 days of signup for a full refund.
- If payment fails, we may pause your access until fixed. No refunds after 30 days for parts you’ve already used.
- Medical Aid Claims: If funded by your medical aid, we can share only what’s needed by law (e.g., diagnosis codes, treatment notes, progress summaries) under the Medical Schemes Act. This helps them pay us and review if the program supports your health long-term. We won’t share full details like prescriptions unless required.
Your Responsibilities
- Share honest health info – we rely on it to help you (you’re responsible if it’s wrong).
- Follow your country’s laws (e.g., rules on online health advice).
- Be respectful to our team and other participants – no bullying or harm.
- Use our tools and platform properly.
Our Rights and What We’re Not Responsible For
- We can change this document (we’ll email or post notice). If you keep using the program, you agree to updates.
- All our content (videos, guides) is ours – you can use it for personal learning but can’t copy, share, or sell it.
- We can pause or end your access if you break rules, for legal reasons, or if something unavoidable happens (like a tech outage or natural disaster – called “force majeure”).
- Liability Limit: To the extent allowed by law, we’re not responsible for program glitches, health issues from our advice (good or bad), or other losses. Your health is ultimately your choice. Our experts have insurance in South Africa and Namibia for their work.
- In a medical emergency, call local help right away – we’re not set up for that.
You agree to cover us (indemnify) if your wrong info causes us problems.
Cancelling
- You Cancel: Email us anytime. Refunds only follow the 30-day guarantee.
- We Cancel: We might end the program (e.g., too few people or legal issues). We’ll refund any unused part fairly.
Disputes
We’ll try to fix any issues by talking first (or through neutral mediation if you want). If needed, South African law applies, and disputes go to courts in Cape Town. As an international participant, you agree to this – it’s fair since we’re based here.
Privacy Policy (How We Handle Your Information)
We take your privacy very seriously – just like a doctor would with your patient notes. This explains what info we collect, why, and how we keep it safe. It follows POPIA rules – we’re the “responsible party” (in charge) and sometimes an “operator” (handling data for a purpose). All our staff (doctors, coaches, admins) might see your info but must keep it private – they get training, sign confidentiality agreements, and follow strict rules.
We only collect what’s needed (data minimisation – meaning we don’t ask for extras, like unnecessary personal details) and use it fairly.
What Info We Collect
- Basic Personal Info: Your name, email, phone, address (for contact or billing).
- Health Info (Sensitive Stuff): Things like blood test results, medical history, current meds, vital signs (e.g., blood sugar, blood pressure). You share this via forms, app updates, or labs.
- Tech and Payment Info: Your device details or IP address (for site security), and payment card info (handled by safe payment companies – we don’t store it).
- How We Get It: From you (forms or chats), automatically (e.g., cookies on our site), or from others (like labs, but only with your okay).
How We Use Your Info
We use it to:
- Run the program: Book sessions, give personal tips, track your progress.
- Handle admin: Process payments, send reminders, improve our services.
- Meet legal needs: Share with medical aids for claims (e.g., basic diagnosis and outcomes under the Medical Schemes Act – no extras).
- Do research: Strip out your name/details (anonymise) to study program results or future group studies. No one can link it back to you – this follows POPIA rules for helpful research (Section 27).
Why It’s Legal:
- Your consent (you agree here – you can take it back).
- To fulfil our agreement (the program contract).
- To support your health (vital interests) or follow laws (e.g., reporting a breach).
We never use it for other reasons, like selling to advertisers.
Who We Share It With
We don’t sell or share carelessly. It goes to:
- Our Team: Only people who need it to help you (all trained and bound by privacy rules).
- Trusted Helpers (with contracts to follow POPIA):
- Companies for our online platform, forms, and video calls.
- Labs and Dr. Snyman for adding your test results to records.
- Payment or medical aid groups (just enough for claims).
- By Law: Courts, health regulators (e.g., HPCSA), or if safety requires it.
- With Your Permission: E.g., to your doctor.
For other countries (e.g., Namibia or EU), we use strong protections like approved contracts to keep data safe during transfers.
How We Keep It Safe and How Long We Hold It
- We encrypt (scramble) it when stored or sent, limit who sees it, and check for risks regularly.
- If there’s a data problem (like a hack), we’ll tell you and the POPIA Regulator quickly (within a month, as required).
- We keep your info while you’re in the program and for 6 years after your last contact (to meet health record laws like HPCSA guidelines and audits). Then we delete it safely, unless law says keep longer.
Your Rights Under POPIA
You control your info. You can:
- Ask to see or fix it (free once a year).
- Say no to certain uses (like marketing).
- Ask to delete or limit it (but we might need to keep some for your health or law).
- Get a copy to take elsewhere (in digital form).
- Complain to the Information Regulator if unhappy (email: inforeg@justice.gov.za | website: www.inforegulator.org.za) or Namibia’s authority.
Just email info@fireforlife.health – we’ll reply in 30 days max. For website visitors (not enrolled), this only covers basic info – no health details.
Cookies and Other Notes
Our site uses cookies (tiny files) to work better and track use – you can turn them off in your browser. For international folks, we match your local privacy rules (e.g., extra consent for EU users).
Changes: We’ll tell you about updates by email or site. If you keep going, you agree.
Informed Consent (You’re Okay for Health Support)
This is your clear, voluntary agreement to join and share health details. It’s based on South African health ethics (HPCSA rules) and POPIA. You can say no or stop anytime (email us) – but that might end your program access and any refunds. Ask questions before agreeing; we want you fully informed.
- Benefits: Personalised education, tracking, and expert guidance to improve metabolic health.
- Risks: No guaranteed results; advice might not fit everyone; rare chance of misunderstanding (e.g., if info is incomplete). Telehealth can’t replace hands-on care.
- Alternatives: See your local doctor, join in-person programs, or do nothing.
- Voluntary: No pressure – you choose this.
When you join a FIRE for Life programme you will the opportunity to confirm that you understand and agree to all of the above. You will then also have the chance to confirm the following:
- Join the Program: Use our online lessons, forms, tracking app, and video consults with South Africa/Namibia experts for education and lifestyle help. I understand the risks and benefits.
- Share Health Info: Give my health details (including sensitive ones like tests/meds) through the program. I okay my lab sending blood results to Dr. Snyman for secure records and analysis in a standard digital format. Sessions may be recorded (we’ll ask first) for better care.
- Consultations: Get online advice from our non-local experts. I’ll see my local doctor for meds, tests, or emergencies. I release the team from blame for health changes (except where law doesn’t allow, like serious mistakes).
- Medical Aid Sharing: If claiming benefits, share needed details (e.g., diagnosis codes, progress notes) for payment and health reviews under law.
- Research: Use my unnamed data to check program success or do group studies later (no way to identify me).
- Team Access: Let all staff see my info only as needed, with full privacy protections.
- Full Acknowledgment: I’m 18+, have self-checked for issues (no big risks I’m aware of). The program is educational support – my health is my responsibility. I agree to the Terms & Conditions, Privacy Policy, and all consents here. I can withdraw anytime, but data stays as per privacy rules.
